Halloween Costume Contest Rules

NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. MAKING A PURCHASE WILL NOT INCREASE ONE’S ODDS OF WINNING A PRIZE.

1. Description: The “Champions Online Halloween Costume Contest” ("Contest") begins at 12:01 AM [PST] on Friday, October 31, 2008 (“Start Date”) and ends at 11:59 PM [PST] on Friday, November 7, 2008 ("Contest Period"). The Sponsor of this Contest is Cryptic Studios, Inc ("Sponsor").

2. Eligibility: Contest is open to legal residents of the fifty (50) United States and Washington, D.C. (specifically excluding Puerto Rico and other US territories and possessions) or Canada (excluding Quebec) who have reached the age of majority in their state/province of residence at time of entry and who have internet access as of the Start Date. Any individuals (including but not limited to employees, consultants, independent contractors and interns) who have, within six months prior to the Start Date, held employment with or performed services for Sponsor or any organizations affiliated with the sponsorship, fulfillment, administration, prize support, judging, advertisement or promotion of the Contest (collectively, "Contest Entities") are not eligible to enter or win. Immediate family and household members of such individuals are also not eligible to enter or win. "Immediate Family" shall mean parents, step-parents, legal guardians, children, step-children, siblings, step-siblings, or spouses. "Household Members" shall mean those people who share the same residence at least three months a year. VOID WHERE PROHIBITED.

3. How to Enter: Visit the Champions Online web site during the Contest Period by logging on to http://www.champions-online.com. Register for the Champions Online community. Registration is free. Follow the posted instructions on how the enter the contest. When you register for the Community, you may be asked to consent to receive promotional e-mails and reminders for upcoming Champions Online events or other promotional activities. Consenting to receive such e-mails is optional and does not have to be agreed to in order to be eligible to enter the Contest and does not improve your chances of winning.

4. Contest Period. All online entries must be received by 11:59 PM [PST] on November 7, 2008. Entrants must provide all information requested by Sponsors to be eligible to win. Incomplete, unreadable, or unintelligible entries will be disqualified. All information provided by entrants becomes the property of Sponsor and will not be returned or acknowledged. Proof of submission does not constitute proof of entry. LIMIT ONE ENTRY OR REGISTRATION PER PERSON, REGARDLESS OF EMAIL ADDRESS USED OR METHOD OF ENTRY. Entries generated by script, macro or other automated means are prohibited and, upon discovery by Sponsor, will be disqualified.

5. Prizes: Grand Prize (6): Six (6) Grand Prize Winners will be selected to receive: one (1) Champions Online Closed Beta Key, one (1) unique forum title. A Grand Prize Winner will not be compensated in any other way should any element of the prize be deemed not feasible. If a prize cannot be awarded due to circumstances beyond the control of Sponsor, a substitute prize of equal or greater retail value may be awarded, provided, however, that if prizes are awarded but unclaimed/forfeited by recipient, prize may not be re-awarded, in Sponsor's sole discretion. Prize winners cannot assign or transfer the prize to another person. No cash or prize substitution is allowed except at the discretion of Sponsor.

ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZES ARE THE SOLE RESPONSIBILITY OF THE WINNER.

6. Winner Selection and Notification: Potential Winners will be selected on or about November 10, 2008. All potential Winners will be notified via the forum private message system on or about November 12, 2008.

7. Conditions of Participation/Releases: Contest is void where prohibited or restricted by law. All federal, state/provincial and local laws and regulations apply. By participating, entrants agree to be bound by these official rules and the decisions Sponsor, which shall be final in all respects. By participating in this Contest and/or by accepting any prize that they may be awarded, entrants agree to release the Contest Entities, their respective parent, subsidiary and affiliated companies, units and divisions, licensors, and advertising and promotional agencies and prize suppliers; each of their respective officers, directors, agents, representatives and employees; and each of these companies and individuals' respective successors, representatives and assigns (collectively, the "Released Parties") from any and all actions, claims, injury, loss or damage arising in any manner, directly or indirectly, from participation in this Contest and/or acceptance or use of the prize. Entrants authorize the Released Parties to use their name, voice, likeness, biographical data, city and state/province of residence and entry materials in programming or promotional material, worldwide in perpetuity, or on a winner's list, if applicable, without further compensation unless prohibited by law. The Released Parties shall not be liable for: (i) incomplete unreadable, inaccurate, garbled or unintelligible entries, communications or affidavits, regardless of the method of transmission; (ii) telephone system, telephone or computer hardware, software or other technical or computer malfunctions, lost connections, disconnections, delays or transmission errors; (iii) data corruption, theft, destruction, unauthorized access to or alteration of entry or other materials; (iv) any injuries, losses or damages of any kind caused by the prize or resulting from acceptance, possession or use of a prize, or from participation in the Contest; or (v) any printing, typographical, administrative or technological errors in any materials associated with the Contest. The Released Parties shall not have any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Contest, and reserves the right, in their sole discretion, to cancel, modify or suspend the Contest should a virus, bug, computer problem, unauthorized intervention or other causes beyond Sponsor's control, corrupt the administration, security or proper play of the Contest. Released Parties may prohibit you from participating in the Contest or winning a prize if, in their sole discretion, they determine you are attempting to undermine the legitimate operation of the Contest by cheating, hacking, submissions of multiple entries, deception, or any other unfair playing practices or of intending to annoy, abuse, threaten or harass any other players or Released Parties’ representatives. This Contest will be governed by the internal laws of the State of California. Any and all legal actions or claims arising in connection with this Contest must be brought in a court of competent jurisdiction within the United States. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION FROM PARTICIPATION IN THE CONTEST. SHOULD SUCH AN ATTEMPT BE MADE, RELEASED PARTIES RESERVE THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

8. Sponsor Ownership of Entries. All entries and materials submitted to Sponsor in connection with the Contest (collectively, "Entry Materials"), along with all copyright, trademark and other proprietary rights associated therewith, become the property of Sponsor upon submission, and Entry Materials will not be returned to any entrant. Without limiting the generality of the foregoing, you acknowledge that Sponsor will own all rights to use, modify, reproduce, publish, perform, display, distribute, make derivative works of and otherwise commercially and noncommercially exploit the Entry Materials in perpetuity and throughout the universe, in any manner or medium now existing or hereafter developed, without separate compensation to you or any other person or entity. You agree to take, at Sponsor's expense, any further action (including, without limitation, execution of affidavits and other documents) reasonably requested by Sponsor to effect, perfect or confirm Sponsor's ownership rights as set forth above in this paragraph 8.

9. Original Work of Authorship. You hereby warrant and represent that (a) you own all rights to all Entry Materials submitted by you; and (b) all such Entry Materials are original works of authorship on your part and have not been copied, in whole or in part, from any other work and do not violate, misappropriate or infringe any copyright, trademark or other proprietary right of any other person or entity.

10. Privacy Policy Any personal information supplied by you to Sponsor will be subject to Sponsor’s privacy policy posted at http://www.champions-online.com/legal_terms. By entering the Contest, you grant Sponsor permission to share your email address and any other personally identifiable information with the corresponding Contest Entities as may be necessary in connection with the administering of this Contest. Subject to your ability to opt-out, you will be automatically registered as a member of Sponsor’s web site and subject to its privacy policy posted at http://www.champions-online.com/legal_terms. As a result, you may receive additional email communication or promotions from the Sponsor as any of their members would. Sponsor will not sell, rent, transfer or otherwise disclose your personal data to any third party other than the Contest Entities.

11. General Release. By entering the Contest, you release Sponsor, participating sponsors and any of their respective parent companies, subsidiaries, affiliates, directors, officers, employees and agencies (collectively, the "Released Parties") from any liability whatsoever, and waive any and all causes of action, related to any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Contest or delivery, misdelivery, acceptance, possession, use of or inability to use any prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory.

14. Prize Winner List: For the list of prize winners, available after November 12, 2008, or a copy of these official rules, mail a self-addressed, stamped envelope to: “Champions Online Halloween Costume Contest” Winner's List or Rules, Cryptic Studios, Inc. P.O. Box 321213, Los Gatos, CA 95032.) (VT residents may omit return postage) by January 1, 2009.
