Introduction

Cryptic Studios respects each individual's right to personal privacy. To better protect your privacy we provide this notice explaining our online information practices and the choices you can make about the way your information is collected and used. To make this notice easy to find, we make it available on our homepage and at every point where personally identifiable information may be requested. This statement applies solely to information collected at Cryptic Studios' Web site.

Part I. Children’s Privacy

Protecting the privacy of the very young is especially important. For that reason, we never collect or maintain information at our website from those we actually know are under 13, and no part of our website is structured to attract anyone under 13.

If you are between the ages of 13 and 18, please let your parent or guardian know about this Policy and get his or her permission before you give us any of your personal identifiable information, before you use any of our message board, instant message or chat features, before you sign up for any subscription game services, and before you buy anything from the Store.

Cryptic Studios encourages parents and guardians to monitor their children’s online activities and to discuss online safety with them. Children should always ask for their parent or guardian’s permission before entering any personally identifiable information on the Internet.

Cryptic Studios complies with the Children’s Online Privacy Protection Act and all other applicable laws and regulations concerning children and the Internet.

Part II. Information Collection

We do not collect any personal information from you, unless you provide it to us voluntarily. If you decide to provide us your personal information, we will only collect the information that is needed to fulfill your requests and our legitimate business objectives. If you refuse to divulge your personal information when requested, you will not be able to access certain areas and services on the Sites (such as message boards and newsletters).

Our Web site offers areas where users can post comments to each other, including forums and blogs. You may be required to register and choose a user name and password to access these features. Please be advised that information posted in these venues becomes public knowledge and other visitors may collect this information. As your user name will be visible to the general Internet public when you use these services, we advise you not to use your real name as your user name. We are not responsible for protecting such information that you may disclose to third parties through our services (e.g. voluntarily sending your telephone number to another user through the forum system).

Some services may ask you to submit information about other people. For example, we may offer "Send to a Friend" promotions, like electronic postcards on our sites or through our newsletters. In these situations, users are asked to provide the e-mail address and, sometimes, the name of a friend. Such information is used only for the explicit reason given and is not retained after being used.

Our sites employ cookies. A cookie is a small text file that our Web server places on a user's computer to be a unique identifier. Cookies enable Cryptic Studios to track usage patterns and deliver customized content to users. Our cookies have an expiration date. Our cookies do not collect personally identifiable information.

We automatically collect and store: the Internet protocol (IP) address of the computer you are using; the browser software you use and your operating system; the date and time you access our sites; and the Internet address of the site from which you linked directly to our sites.

Part III. Information Usage

We use non-identifying and aggregate information to better design our website and to share with advertisers. Aggregate Information is information in summary form which does not contain data that would permit the identification of a specific individual. For example, we may tell a business partner that X number of individuals visited a certain area on our website, or that Y number of men and Z number of women filled out our registration form.

Registered users may receive additional announcements from us about products, services, special deals, and a newsletter. Out of respect for the privacy of our users we present the option to not receive these types of communications.

We offer links to other Web sites. Please note: When you click on links to other Web sites, we encourage you to read their privacy policies. Their standards may differ from ours.

Personal information which we collect for a particular purpose will only be saved and used for that purpose, unless you have agreed to allow us to use it for some other purpose, as described in this Policy. For example, if you make an online purchase from us, and unless you have given us permission to do otherwise, we will only collect and save the personal information you provided to us, including your billing and delivery information, in order to (1) complete the sale, (2) comply with tax and other applicable statutes, (3) maintain accurate business and financial records (in accordance with accepted standards), and (4) assist with customer service and returns.

When you have provided personal information to us for a particular purpose, we may disclose your information to other companies that we have engaged to assist us in fulfilling your request. This may include, but is not limited to, fulfillment houses, transaction managers, credit verification services, and other service providers. We may also disclose your personal information to law enforcement or other appropriate third parties in connection with criminal investigations, investigation of fraud, infringement of intellectual property rights, or other suspected illegal activities, or as otherwise may be required by applicable law, or in order to protect the legitimate legal and business interests of Cryptic Studios.

Part IV. Access to Information

Cryptic Studios maintains the accuracy of our information through the cooperation of the users. Users may access their own personal information through the My Account link at the top of the Cryptic Studios sites and may contact us about inaccuracies they may find. Users may delete their information from our database by utilizing the features provided in the various account management functions. Deleted account names are retained and other users, including the original user, may be prohibited from creating an account with the same name. No other information will be stored for deleted accounts.

Part V. Problem Resolution

If problems arise, users may contact Cryptic Studios by sending an email to privacy@crypticstudios.com. We are committed to resolving disputes within 30 days.

Part VI. California Privacy Rights

California Civil Code Section 1798.83 permits customers of the Cryptic Studios who are California residents to request certain information regarding its disclosure of personal information to third parties for their direct marketing purposes. Part VI. Data Storage and Security

To prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, Cryptic Studios has put in place appropriate physical, electronic, and managerial procedures to safeguard and secure the information we collect online.

Part VII. Persons outside the United States

By consenting to this Privacy Policy, you confirm that your command and knowledge of English (or in some cases, French, German, Italian or Spanish) is sufficient to understand the terms and conditions set forth herein.

For persons in European Union countries, as used herein, terms such as "personal information" refer to "personal data" as defined by the Directive 95/46/EC of the European Parliament and of the Council of 24 October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data ("Directive"). Cryptic Studios will not collect any personal data from you unless you provide it voluntarily by providing Cryptic Studios with your freely given specific and informed consent. By using Cryptic Studios Sites or Services, you agree that Cryptic Studios may transfer your personal information outside the European Union in connection with the purposes stated in this Privacy Policy. Your personal data may be transferred to the United States (and/or other non-EU jurisdictions, as applicable).

In certain jurisdictions in which local law may be required to apply, some of the information collected by Cryptic Studios (or its designees) may be personal information and entitle you to the right to object to its collection and to the right to access and correct the collected information pertaining to you.

Part IIX. Notice of changes to the Privacy Policy

Cryptic Studios reserves the right to change this Policy at any time by notifying registered users via e-mail of the existence of a new Policy and/or posting the new Policy on the Cryptic Studios sites. All changes to the Policy will be effective when posted, and your continued use of any Cryptic Studios site or service after the posting will constitute your acceptance of, and agreement to be bound by, those changes.
